Trips and slips

The correct defendant and cause of action

The starting point when bringing a claim for a trip or slip is to identify where the accident occurred.

There are different types of trip/slip claims including:

  1. •

    in the workplace

  2. •

    on a highway

  3. •

    in a shop

  4. •

    a claim arising from breach of the Occupiers' Liability Acts

Trips and slips in the workplace

The Workplace (Health, Safety and Welfare) Regulations 1992, SI 1992/3004 set out employers' duties relating to buildings and facilities. Under the regulations an employer must:

  1. •

    ensure that all work stations are suitably arranged

  2. •

    ensure that all floor and traffic routes are suitable for their purpose

  3. •

    maintain all equipment, systems and devices in efficient working order and good repair

  4. •

    provide adequate ventilation, temperature and lighting

  5. •

    ensure that all furniture, fittings, floors, walls and ceilings are kept clean

A significant number of trip/slip claims arise from lawful visitors to shops. Shops are under a duty to keep their floors clean and free
