B6.206 Rent receivable from mines, quarries etc.

Business tax

Profits arising from land in respect of certain concerns (for example, mines, quarries, etc) are taxed as if they were from trades even though the source of the profits is land (and therefore ought to come within the scope of property income in ITTOIA 2005, ss 260–364, Pt 3 or CTA 2009, ss 202–291, Pt 4), for more details on the treatment of these trades see B5.651. The list of these concerns is found in ITTOIA 2005, s 12(4) and CTA 2009, s 39(4) and hence the legislation refers to them as 's 12(4) concerns' or 's 39(4) concerns'. These concerns comprise:

  1. Ìý

    (1)ÌýÌýÌýÌý mines and quarries, including gravel pits, sand pits and brickfields

  2. Ìý

    (2)ÌýÌýÌýÌý ironworks, gasworks, salt springs or works, alum mines or works (other than mines within (1) above), and waterworks and streams of water

  3. Ìý

    (3)ÌýÌýÌýÌý canals, inland navigation, docks, and drains or levels

  4. Ìý

    (4)ÌýÌýÌýÌý rights of fishing

  5. Ìý

    (5)ÌýÌýÌýÌý rights of markets and fairs, tolls, bridges and ferries

  6. Ìý

    (6)ÌýÌýÌýÌý railways and other kinds of way; and
