SI relief is withdrawn if the whole or part of the investment is disposed of before the shorter applicable period (see E3.902) ends1. There are two exceptions to this rule: transfers between spouses or civil partners , and disposals as a result of the investor's death2.
If the disposal is not on arm's length terms, all SI relief is withdrawn. In the case of an arm's length bargain, SI relief is reduced or withdrawn to the extent of the consideration received at the SI rate for the year in which it was given3.
