Possession of LTA 1954 excluded tenancy


A tenant will lose the right to remain in occupation of a commercial property after the expiry of the contractual term in the following situations:

  1. •

    the lease is contracted out of the security of tenure provisions of the Landlord and Tenant Act 1954 (LTA 1954)

  2. •

    the lease is not contracted out of the security of tenure provisions of LTA 1954, but the tenant does not satisfy the criteria for a continuation lease in LTA 1954, s 23 (see Practice Note:
